Welcome to DiecastModelsWholesale.com (the "Site"), owned and operated by ANAA INC. ("ANAA INC." "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the Site and your purchase of products from ANAA INC. through the Site. By accessing or using the Site, creating an account, placing an order, purchasing products, or otherwise interacting with our services, you agree to be bound by these Terms and any policies referenced in them.

If you do not agree to these Terms, please do not use the Site or purchase products from us.

These Terms apply to purchases made through the Site by customers in the United States and, where we offer international sales or delivery, customers outside the United States.

  1. Eligibility and Use of the Site

You must have the legal capacity to enter into a binding agreement under applicable law to make purchases through the Site.

If you create an account, you agree to provide accurate, current, and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account. Please notify us promptly if you believe your account or credentials have been used without authorization.

We reserve the right to restrict or terminate access to the Site for violations of these Terms or for conduct that may harm the Site, our business, or other users.

  1. Accounts

Certain features of the Site may require an account.

You are responsible for maintaining the confidentiality of your username, password, and other account credentials and for all activity occurring through your account.

You agree to notify us promptly if you believe that your account has been compromised.

We may suspend or terminate an account when permitted by applicable law, including when we reasonably believe the account is being used fraudulently, unlawfully, or in violation of these Terms.

You may contact us if you wish to close your account. Closing an account does not necessarily delete information that we are legally required or otherwise permitted to retain.

Our collection and use of personal information are governed by our Privacy Policy.

  1. Products and Product Information

We make reasonable efforts to accurately describe and display the products offered on the Site, including product photographs, colors, dimensions, specifications, materials, brands, manufacturers, and other product information.

However:

  • Product photographs may appear different depending on your monitor, device, or display settings;
  • Packaging, markings, colors, accessories, and other product details may vary from photographs or descriptions;
  • Manufacturers may change product specifications, packaging, designs, or production details without notice;
  • Product availability may change at any time; and
  • We do not guarantee that every product description, photograph, specification, or other Site information is complete, current, or error-free.

Collectible products may have minor variations resulting from manufacturing, packaging, finishing, assembly, or production processes.

Unless expressly stated otherwise, product photographs and illustrations are provided for identification and descriptive purposes.

  1. Product Availability

Products displayed on the Site are subject to availability.

A product being displayed on the Site does not guarantee that the product will remain available when you place an order or that your order will ultimately be fulfilled.

We may discontinue products, change product availability, limit quantities, or remove products from the Site at any time.

For limited-edition, collectible, preorder, discontinued, or otherwise highly limited products, availability may be especially subject to change.

If we are unable to fulfill an order because a product is unavailable, we may cancel the affected portion of the order and refund amounts charged for that product.

  1. Prices and Pricing Errors

Prices displayed on the Site are in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, shipping charges, and product availability may change without notice.

We make reasonable efforts to ensure that prices and other information displayed on the Site are accurate. However, errors may occur, including typographical errors, pricing errors, promotional errors, or technical errors.

We reserve the right to correct errors, inaccuracies, or omissions and, where permitted by applicable law, to cancel or modify an order affected by such an error, including after an order has been submitted.

If we cancel an order after you have been charged, we will refund the amount actually charged for the canceled merchandise.

  1. Orders and Order Acceptance

Submitting an order through the Site constitutes an offer by you to purchase the products identified in your order.

After you submit an order, you may receive an order confirmation email. An order confirmation acknowledges receipt of your order but does not necessarily mean that ANAA INC. has accepted the order or that the products are available for shipment.

We reserve the right to accept, reject, cancel, or limit any order for legitimate reasons, including:

  • Product availability;
  • Pricing or product-information errors;
  • Suspected fraud or unauthorized activity;
  • Payment authorization problems;
  • Inaccurate billing or shipping information;
  • Unusually large quantities;
  • Abuse of promotions or discounts;
  • Shipping restrictions;
  • Violations of these Terms; or
  • Other circumstances permitted by applicable law.

We may limit quantities purchased by a customer, household, account, payment method, billing address, shipping address, or other applicable purchasing information.

If an order is canceled after payment has been received, we will refund the amount charged for the canceled merchandise.

  1. Payment

You agree to provide accurate, complete, and current billing, payment, and account information.

By submitting an order, you authorize us and our payment service providers to process the applicable payment for the order.

Payment authorization does not guarantee order acceptance or fulfillment.

If payment cannot be authorized, is reversed, or is otherwise unavailable, we may cancel or suspend the affected order.

You represent that you are authorized to use the payment method submitted with your order.

  1. Sales Tax and Other Taxes

Applicable sales, use, and other taxes will be calculated and collected as required by applicable law.

Tax amounts may vary depending on the shipping destination, customer pickup location, applicable tax rules, and the nature of the transaction.

For international orders, customers may also be responsible for customs duties, import taxes, brokerage charges, or other charges imposed by the destination country or governmental authority.

  1. Shipping and Delivery

Shipping methods, estimated processing times, shipping charges, and other shipping information are described in our Shipping Policy

Shipping and delivery dates or timeframes displayed on the Site are estimates unless expressly identified as guaranteed.

We make reasonable efforts to fulfill orders within the shipment timeframe stated at the time of purchase. Where no shipment timeframe is stated, orders will be handled in accordance with applicable law.

If we determine that an order cannot be shipped within the applicable promised timeframe, we will provide any notices, options, cancellations, or refunds required by applicable law.

Shipping carriers may experience delays caused by weather, transportation disruptions, address problems, customs processing, carrier issues, or other circumstances beyond our reasonable control.

Carrier delivery estimates are not guarantees of delivery.

  1. Shipping Addresses

You are responsible for providing an accurate and complete shipping address.

We are not responsible for delays, additional shipping charges, returns, or delivery problems resulting from incorrect or incomplete information provided by you, to the extent permitted by applicable law.

If a package is returned to us because of an incorrect address, refusal of delivery, failure to claim the package, or similar circumstances attributable to the customer, additional shipping or handling charges may apply where permitted by law.

  1. International Orders

We may offer products for shipment to locations outside the United States.

International shipping availability may vary by destination, product, carrier, manufacturer restrictions, applicable laws, customs requirements, and other circumstances.

For international orders:

  • Delivery times are estimates and may be affected by customs processing;
  • The recipient is responsible for providing accurate shipping information;
  • The recipient may be responsible for customs duties, import taxes, brokerage fees, tariffs, or other charges imposed by the destination country;
  • The recipient is responsible for complying with applicable import laws and regulations;
  • Certain products or destinations may not be eligible for international shipment; and
  • We may cancel or refuse an international order when fulfillment would violate applicable law or when shipment is not reasonably practicable.

ANAA INC. is not responsible for delays caused by customs authorities or other governmental agencies.

  1. Customer Pickup

Where offered, customers may have the option to pick up eligible orders from our designated pickup location.

Pickup availability, hours, procedures, and eligible products may be subject to change.

An order designated for pickup will not be considered available for collection until ANAA INC. has confirmed that it is ready.

Customers picking up an order may be required to provide order information and reasonable identification or other information necessary to verify the pickup.

Only the customer or an authorized person may collect an order, subject to our verification procedures.

Once an order has been released to the customer or an authorized pickup person, the customer's possession of the merchandise is established, subject to applicable law and our Return Policy.

Customer pickup does not necessarily mean that our facility operates as a walk-in retail store or that products are available for purchase without an online order.

  1. Returns, Refunds, and Exchanges

Returns and refunds are governed by our Return Policy

The Return Policy may contain different rules for certain products, including clearance merchandise, closeout merchandise, preorders, special orders, opened products, damaged merchandise, or other specified products.

Nothing in these Terms is intended to limit any non-waivable rights or remedies available to consumers under applicable law.

  1. Preorders and Backorders

Certain products may be offered for preorder or backorder.

Estimated release dates supplied by manufacturers or displayed on the Site are estimates and may change.

Manufacturer production schedules, shipping schedules, allocation changes, production delays, and other circumstances may affect availability.

If a preorder or backordered item is delayed, canceled, discontinued, or otherwise cannot be fulfilled, we may notify you and provide cancellation or refund options as required by applicable law and our applicable policies.

Where a preorder involves payment before shipment, applicable payment, cancellation, and refund practices will be disclosed at the time of purchase or in the applicable product or preorder information.

  1. Promotions, Coupons, and Discounts

Promotional codes, coupons, discounts, special offers, and other promotions may be subject to additional terms and restrictions.

Unless expressly stated otherwise:

  • Promotions cannot be combined with other offers;
  • Promotional offers may have expiration dates;
  • Certain products, brands, categories, or orders may be excluded;
  • Promotional codes may not be transferred, sold, or reproduced; and
  • We may cancel or refuse promotional benefits obtained through fraud, abuse, technical errors, or violation of promotional terms.

If promotional terms conflict with these Terms, the specific promotional terms will control with respect to that promotion.

  1. Intellectual Property

The Site and its contents, including but not limited to text, product descriptions, photographs, graphics, logos, videos, designs, software, databases, page layouts, compilations, and other materials, are owned by ANAA INC., its licensors, or other applicable rights holders and are protected by applicable intellectual-property laws.

You may access and use Site content solely for lawful personal or legitimate purchasing purposes.

Except as permitted by law or expressly authorized by ANAA INC. in writing, you may not:

  • Copy or reproduce Site content;
  • Republish or redistribute Site content;
  • Modify or create derivative works from Site content;
  • Use Site photographs or product images for commercial purposes;
  • Systematically download or archive Site content;
  • Use automated tools to scrape Site content;
  • Sell, license, or commercially exploit Site content; or
  • Remove copyright, trademark, or other proprietary notices.

All trademarks, service marks, logos, and other brand identifiers appearing on the Site belong to their respective owners.

  1. Product Images, Manufacturer Information, and Third-Party Intellectual Property

Many products sold through the Site are manufactured by independent manufacturers and brands.

Manufacturer names, trademarks, logos, product names, and related intellectual property remain the property of their respective owners.

ANAA's INC. use of such information is intended to identify and describe products offered for sale.

Nothing in these Terms grants you any ownership interest in third-party trademarks, copyrights, photographs, or other intellectual property.

  1. User Reviews and User-Submitted Content

If the Site allows you to submit reviews, photographs, comments, questions, videos, or other content ("User Content"), you are responsible for the content you submit.

You represent that you have the necessary rights to submit User Content and that your submission does not violate applicable law or the rights of others.

You agree not to submit User Content that:

  • Is unlawful, fraudulent, defamatory, threatening, harassing, obscene, or otherwise objectionable;
  • Infringes another person's intellectual-property or privacy rights;
  • Contains another person's confidential or sensitive personal information;
  • Contains malicious software or harmful code;
  • Impersonates another person or entity; or
  • Violates these Terms.

By submitting User Content to areas of the Site where submissions are intended to be publicly displayed, you grant ANAA INC. a non-exclusive, royalty-free license to use, reproduce, display, distribute, and publish that User Content in connection with operating, promoting, and improving our business and Site, subject to applicable law.

You retain ownership of your User Content.

Nothing in these Terms requires you to give up your right to post an honest review of your experience or otherwise exercise rights protected by applicable law.

  1. Third-Party Websites and Services

The Site may contain links to third-party websites, services, payment providers, shipping providers, manufacturers, social-media platforms, or other third-party resources.

ANAA INC. does not control third-party websites or services and is not responsible for their content, policies, availability, security, or practices.

Your use of third-party websites and services is subject to their respective terms and policies.

  1. Website Availability and Technical Errors

We make reasonable efforts to maintain the availability and functionality of the Site, but we do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

The Site may occasionally be unavailable because of maintenance, upgrades, technical problems, cybersecurity incidents, hosting problems, telecommunications failures, or other circumstances.

We may modify, suspend, discontinue, or restrict portions of the Site at any time.

  1. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

ANAA DISCLAIMS WARRANTIES AND CONDITIONS THAT MAY BE DISCLAIMED UNDER APPLICABLE LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ANAA INC. DOES NOT WARRANT THAT:

  • THE SITE WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED;
  • THE SITE WILL BE FREE FROM ERRORS OR DEFECTS;
  • INFORMATION ON THE SITE WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT;
  • THE SITE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL CODE; OR
  • PRODUCTS WILL ALWAYS BE AVAILABLE.

NOTHING IN THESE TERMS DISCLAIMS A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.

Products may also be subject to manufacturer warranties or guarantees, where applicable. Any such manufacturer's warranty is provided by the applicable manufacturer rather than ANAA INC. unless ANAA INC. expressly states otherwise.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANAA INC. AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANAA'S INC.  TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE OR CLAIM WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO ANAA FOR THE PRODUCT OR PRODUCTS DIRECTLY GIVING RISE TO THE CLAIM.

THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW AND DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

  1. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless ANAA INC. and its owners, officers, directors, employees, agents, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your violation of these Terms;
  • Your unlawful use of the Site;
  • Your fraud or intentional misconduct;
  • Your violation of another person's rights; or
  • User Content submitted by you that violates the rights of another person.

This provision does not require you to indemnify ANAA INC. for ANAA's INC. own conduct to the extent such indemnification is prohibited by applicable law.

Nothing in these Terms limits rights that cannot lawfully be waived under California law.

Mandatory consumer protections that cannot legally be waived under the laws applicable to a customer's jurisdiction remain unaffected.

You may not assign your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

  1. Entire Agreement

These Terms, together with the policies and terms expressly incorporated into them, constitute the agreement between you and ANAA INC. concerning your use of the Site and purchases made through the Site.

If a specific product, promotion, preorder, shipping, or return policy contains additional terms that apply to a transaction, those specific terms will apply to the extent they conflict with these Terms.
